Please review these Terms of Service carefully before using Greenpool's Service. These terms outline your rights, obligations, and essential details about using our service.
These Terms of Service govern all services provided by Greenpool Ltd., a company registered in Kitchener, Ontario, Canada (Registration Number: OCN:1000648681, registered on September 11, 2023), with its registered office at 140 Colton Circle, Kitchener, Ontario, N2A 4K6.
Here at Greenpool Ltd. (referred to as "CARPOOLL.COM," "we," "us," or "our"), we operate an online platform connecting Drivers who have available seats on a Trip with Riders seeking transportation for the same Trip (collectively, the "Services"). These Services are accessible through our Website at https://Carpooll.com/ and other subdomains or mobile applications provided by Greenpool (collectively, the "Service").
By using our Service, you agree to these Terms of Service ("Terms"), which legally bind you whether or not you register for the Service. Please read these Terms carefully as they govern your use of the Service, including content from all Members and Carpooll.com. If you disagree with these Terms, you should not continue using or accessing the Service or its content.
Non-compliance with these Terms may lead to civil or criminal penalties.
The Service is an online platform where Drivers and Riders can post and arrange carpooling trips directly with each other, strictly in a non-commercial or non-professional capacity. By using the Service, you acknowledge that Carpooll.com is not a party to any agreements made between Drivers and Riders and has no control over the behaviour of Drivers, Riders, or Members. You also understand that Carpooll.com is not an insurer, agent, or broker, and you release us from all liability in this regard to the fullest extent permitted by law.
Our Service connects Drivers (defined below) and Riders (defined below) who wish to arrange shared Trips (defined below) for Carpooling (defined below) purposes in a non-commercial context. By using our Service, you acknowledge that Carpooll.com is not involved in any agreements made between Drivers and Riders, nor do we control their conduct.
Please note that Carpooll.com is not an insurer, agent, or broker. We disclaim any liability regarding these matters to the fullest extent the law permits.
1.1 “User” is a Driver, a Rider, both or any other registered user of the Service.
1.2 “Driver” is a person utilizing the Service and offering empty seats in their vehicle to share with other riders.
1.3 “Rider” is someone using the Service and Booking seats in a Driver’s vehicle.
1.4 “Account” is created by a User to access the Service.
1.5 "Trip" refers to a journey that takes place between a specified origin and destination at a particular date and time. It includes details such as the pick-up and drop-off points, space for personal belongings, and the number of available seats. The Trip is created and managed by the Driver.
1.6 "Booking" refers to paying the Contribution for a Trip through the Service before the Trip takes place.
1.7 "Request” is posted by a Rider seeking a Trip between a specific origin and destination on a certain date.
1.8 "Contribution" refers to the amount of money agreed upon and paid by the Rider to the Driver to cover the costs of a specific Trip, and it must not result in profit for the Driver.
1.9 "Platform fees” is a service fee added on top of a Contribution and paid by the Rider when Booking a Trip.
1.10 "Payment" refers to the total amount of money a Rider pays when Booking a Trip, which includes both the Contribution and the Booking fee.
1.11 "Payout" refers to the Contributions collected from Bookings on a Trip and subsequently transferred to the Driver using their chosen Payout method.
1.12 "Payout fee" is a service charge deducted from a Driver's Payout based on the Contributions they receive from Riders for a Trip.
1.13 "Payout method" refers to transferring a Payout to a Driver, which may be either Direct Deposit or PayPal.
1.14 "Cancellation allowance" is the permission for Drivers to cancel up to one Trip with approved Riders or one approved Booking every six months.
1.15 "Taking a ride," "Carpool," "Carpooling," or "Hailing a ride" refer to the act of sharing a Trip in a vehicle between a Driver and Rider(s) in exchange for a Contribution.
2. User Responsibilities
2.1 Members are requested to confirm their Account using their email or phone number. We do not look into the reputation, behavior, ethics, criminal history, or any other details shared by Service members. You are responsible for using common sense and assessing whether other Service Members are suitable. We recommend that you directly contact potential Drivers or Riders through the Service and exercise the same level of caution as you would when meeting someone for the first time.
2.2 You are the only one accountable for how you engage with other members of our service. We are not liable for any harm or damage caused by your interactions with other Members. We retain the right to observe communications and limit entry for any Member sharing content we find inappropriate.
Our Service functions as a mediator in the event of disagreements between Members. Except as required by the "Loi sur la protection du consommateur québécois," you waive all claims against us and our affiliates regarding disputes.
2.3 Our Service serves as a mediator for disputes between Members. Except as required by the "Loi sur la protection du consommateur québécois," you agree to waive any claims against us and our affiliates related to such disputes.
3. User Conduct
3.1 As a User of this Service, you are required to act responsibly and use good judgment. This includes, but is not limited to, the following:
It is operating a vehicle cautiously, following traffic regulations, abstaining from substance use, complying with all laws and regulations, and driving a well-maintained vehicle that has passed necessary inspections.
3.1.1 Not using information obtained through this Service for any unauthorized purpose
3.1.2 Avoiding any disruption or harm to the Service. We arrive with sincere intentions. We are avoiding the distribution of spam through this Service.
3.1.3 Treating other Members with respect: the Service does not allow any harassment, abuse (verbal or physical), or stalking.
3.1.4 Not using the Service for commercial activities unless otherwise agreed directly with Carpooll.com
3.1.5 Not registering for the Service on behalf of another individual
3.1.6 To access and use the Service or create an Account, individuals must be at least 18 years old and capable of entering into legally binding contracts. Using the Service, you confirm that you are 18 or older and have the legal ability and authorization to agree.
3.1.7 Not assisting a third party in doing any of the above
3.1.8 Reporting inappropriate behavior: If you witness inappropriate behavior from another member, such as offensive or violent conduct, you should report it to the proper authorities and us. Note that reporting does not require us to act or assume liability.
4. Guidelines and Restrictions
4.2 Entry to the Carpool service
Every Carpooll.com Member must establish an Account in order to use the Service. To set up an Account, you need to:
4.2.1. You can either sign in or sign up for the service.
4.2.1.1. Sign in by using your Facebook or Google Account through Open Authentication techniques (OAuth). By utilizing OAuth methods, you acknowledge that Carpooll.com can retrieve data from your Facebook or Google Account and share specific details on the Service. In the "Social Accounts'' section of your Account settings, you can disconnect your Carpooll.com account from your Facebook or Google accounts.
4.2.1.2. Alternatively, you can sign up by providing your email and password and filling out all necessary fields on the registration form.
4.2.2 Confirm your email address and ensure you can access it using the Service.
4.2.3 Confirm your mobile number and gain permission to
communicate with other Members through calls and text messages when utilizing the Service.
4.2.4 Provide your legal first name and last name
4.2.5 Provide a well-lit profile photo of yourself that clearly shows your face
4.2.6 Provide your nature in the description
4.2.7 Provide your age and gender according to your legal document.
4.2.8 Agree to our Terms of Service and Privacy Policy
5. User Responsibilities

7.2.7 Provide your age and gender according to your legal document.
7.2.8 Agree to our Terms of Service and Privacy Policy
By signing up for your account, you commit to providing correct and honest details and keeping it current by updating your profile or notifying Carpooll.com.
You agree to take full ownership of your Account and refrain from sharing its access with anyone else.
You acknowledge that all interactions, transactions, reservations, financial transactions, and utilization of the Service's offerings are solely made by you and not by or for someone else.
You agree not to make or utilize any Accounts, either under your name or someone else's, apart from the one you created initially.
You might need to input an email and password during the registration procedure. You are entirely accountable for the discretion and handling of these. You need to alert us immediately if your login information is used without authorization or if there is any security breach.
7.3 Not using the Service for commercial activities unless otherwise agreed directly with Carpooll.com
Drivers are not allowed to pick up Riders from any place that has not been pre-arranged with the Riders using the Service.
Drivers are prohibited from posting Trips without certainty. Drivers must be entirely sure of their travel plans regarding time and location to offer a dependable service to Riders by posting Trips.
Drivers are not allowed to make money from any trip. The Service and the cost contribution can only cover the Driver's expenses and cannot be used to make a profit for the Driver. The Driver cannot profit based on Trip Contribution amount, types of Trips offered, frequency of Trips, or number of Riders transported. This applies to any activities, arrangements, and services reserved through the Service and any extra services or activities agreed upon by the Driver and Rider.
The Driver cannot offer extra services to any Rider for financial benefit (and the Rider cannot seek or receive such services), such as package delivery, extended waiting time, extra stops, and picking up other Riders (apart from the Rider).
Pre-arrangement of all outings and pick-up and drop-off locations is required beforehand through the Service. Drivers are only allowed to pick up Riders from locations previously agreed upon with the Riders through the service.
Drivers are only allowed to post Trips with specific plans. To provide a dependable service for Riders, Drivers must be entirely sure of their travel details before posting Trips.
Drivers are cautioned that operating the Service for commercial or professional purposes could void a Driver's insurance. Carpooll.com’s responsibility is restricted as outlined in the Terms of Service. This includes not being held accountable for any violations of agreements between Members or breaches of the Terms of Service by any Member. This also applies to situations where a Driver offers services professionally or commercially, which may affect their insurance coverage. Members are responsible for remaining watchful and ensuring that services are not offered for profit.
Carpooll.com does not offer transportation services. The Carpool Service is a digital tool enabling Members to communicate and make transactions with each other. Carpooll.com does not disrupt trips, destinations, or schedules. The Carpooling agreement is established between the Driver and the Rider. Carpooll.com is not involved in any agreements or transactions between Members and is not responsible for any issues arising from a Booking between Members. Carpooll.com does not and will not serve as a representative for any Member.
Violating these Terms of Service will result in the prompt suspension of a Member's Account and potential limitations on their access to additional Services.
7.4 Eligibility to use the Service
Carpooll.com provides a carpooling platform for users to connect and plan carpool rides with each other. The Rider should contact the Driver using the Service to coordinate a Carpool and discuss any travel conditions (such as luggage size, equipment, etc).
Carpooll.com has the authority to decide if a Member can access the Carpool service and can choose to remove this service from any Member at any time.
7.5 Conditions under which Carpooll.com operates
Carpooll.com reserves the right to:
7.5.1 Withdraw the Service or limit its availability to a specific group of Users and a select number of destinations.
7.5.2 We may make exceptions to the policies of the Service
8. Features accommodated by Carpooll.com app
8.1 Trips
The Driver suggests journeys on the platform by stating the starting and finishing points, departure date and time, seat availability, and any additional important details.
The Driver planning a journey must be the primary driver of that journey and cannot pass on the driving duties to someone else. Before starting the trip, it is necessary to inform and obtain consent from Riders if another driver will be joining the trip.
During a journey, Riders have the ability to message each other and make reservations with the driver.
8.1.1 Messages(In app conversation)
Carpooll.com offers a communication tool called "Messages" that allows users to stay in touch. Communication can occur between the Driver and the Rider to talk about specific aspects of the Trip.
Kindly be aware that it is not permitted to share personal contact information like email addresses, phone numbers, or website URLs through the messaging service until a booking has been officially accepted.
8.1.2 Bookings
The Rider can reserve one or multiple seats through the Service by making an online Payment with a valid credit or debit card. Carpooll.com receives the Payment, which confirms a Booking for the Trip.
Once a Booking on a Trip has been successfully made, both the Driver and Rider are obligated to fulfill the Booking, with any cancellations subject to the terms outlined in Section 8.5 below.
Notifications are sent to the Driver and Rider's email or phone linked to their Carpooll.com account to inform them of the Booking. The reservation is only considered legitimate if it is made under the name registered by the Member of the Service and will be invalid if it is made under any other name. The Driver must finish the Trip according to the agreement made with the Rider when a Booking is made. The Driver needs to make sure that there are sufficient seats in their vehicle to seat every Rider with a seatbelt comfortably.
Drivers can opt to receive Bookings on their Trip through two different systems.
8.1.2.1 In the Request to Book system, the Driver chooses whether to manually accept or reject each Booking request for their Trip.
Riders seek to reserve a Journey with a Driver by initiating a Payment authorization on their card. Travelers can choose a booking request expiration time of 1 to 24 hours, during which the driver must manually accept or reject the booking request.
If the Driver agrees to the Booking request, the Booking is confirmed, and the Rider's Payment is taken, charging the Rider's card.
If the Driver rejects the Booking request, the Rider's Payment is not taken, and the authorization is removed from the Rider's card, causing the Booking to be cancelled.
If the Driver either accepts or rejects the Booking request, it will expire when the Booking request expiry time is up, and the Rider's Payment is not taken.
The Rider is able to cancel a Booking request for free as long as the Driver has not yet accepted it. The Rider's payment is not recorded, and the authorization has been removed from the Rider's card.
8.2 Currency
Payments and payout are only processed in Canadian Dollars($CAD)
8.3 Payments Policy
8.3.1 In-app Online Payments Only - No Cash
Carpooll.com operates a Service with online Payments to ensure a dependable and successful Carpool experience. All Payments for this Service must be processed online through the secure Payment service provided by Carpooll.com.
Using any alternative methods of payment, such as cash or e-transfers, both online and offline, is not permitted and could result in your Account being terminated.
8.3.2 Third party payment processing
Stripe, a secure online Payment gateway, is utilized by the Service to gather Payments. Stripe has achieved PCI Service Provider Level 1 certification, which is considered the strictest level of certification. Stripe securely stores your credit card details, and no sensitive data is stored on Carpooll.com servers.
When you utilize Carpooll.com, you consent to Stripe securely storing and accessing your personal credit details in accordance with Stripe's terms of service.
After Stripe processes your money, it is securely held in escrow by Carpooll.com.
8.3.3 Platform Fees
Carpooll.com collects a fee for each booking made through the Carpool service with Bookings, called the "Booking fee."
The Booking fee, which is incurred in addition to the Trip contribution, is to be paid by the Rider upon Booking.
8.3.4 Interests
Payments for Contributions made through the Service’s Booking service that are owed to Drivers may accrue interest if not paid out promptly, under exceptional circumstances. The Member agrees not to claim any interest accrued on any Payment due to them.
8.3.5 Fraud Policy
Members commit to complying with requests from Carpooll.com, the bank, or any legal entities in order to prevent or combat fraud and/or money laundering. Specifically, Members commit to providing valid identification documents in response to such Requests. In case of a quick reaction to those Requests, Members consent beforehand to permit Carpooll.com to temporarily hold any money owed to them for Trips or Bookings on the Service and/or limit their use of the Service.
8.4 Driver Payouts
8.4.1 Payout Methods
8.4.1.1 Payout direct to any Canadian Financial Instituiton or to Debit card.
8.4.2 Payout Process
8.4.2.1 To prevent fraud we use Stripe onboarding flow for user identity verification. Which will require you to submit Government issue photo Id and active phone number to verify your identity.
8.4.3 Successful payout process
8.4.4 Payout Fee
8.4.4.1 There is no fee associated to Driver payout.
8.5 Guidelines regarding cancellations, instances of no-shows, and disputes
8.5.1 Rider Cancellation Policy
8.5.1.1 When a Rider cancels a Booking at least 12 hours before the Trip's departure, they will be refunded the total Trip Contribution amount. Carpooll.com will retain the Booking fee as a cancellation fee.
8.5.1.2 If the Rider cancels within 12 hours of the Trip's scheduled departure, the Driver gets 50% of the Contribution, the Rider receives a refund for the remaining 50%, and Carpooll.com retains the Booking fee.
8.5.1.3 If the Rider cancels or doesn't arrive within 10 minutes after the Trip's scheduled departure time, the Driver gets 100% of the Contribution while Carpooll.com retains the Booking fee. The Rider will not receive any refund.
8.5.1.4 If a Rider cancels, their seats on the Trip are given to other Service Members and must follow the rules in the Booking and Cancellations policies provided.
8.5.1.5 If a Driver cancels a Trip after a Rider cancels a Booking, the Rider is issued a full refund, which includes the Booking fee.
8.5.1.6 In the case of wanting to reserve,
8.5.1.6.1 A Rider can cancel a booking request for free before it is approved.
8.5.1.6.2 In the event that the Booking request expires, the Rider will not be billed.
8.5.1.6.3 The Booking fee is not applied in either scenario, and a complete refund is given.
8.5.1.7 Carpooll.com can give refunds to Riders in situations that are deemed fair by the company, even if it goes against the Rider cancellation policy. Some examples include (but are not limited to):
8.5.1.7.1 when a reservation is made using a deceitful payment method
8.5.1.7.2 If the driver is providing an unsanctioned commercial service.
8.5.1.7.3 If a Rider makes an error during booking and asks for a refund within a reasonable period of time
8.5.1.7.4 when a Driver accepts a Booking request before discussing the Trip details with the Rider beforehand
8.5.1.8 Continuous cancellation of reservations by a traveller could result in the termination of their account.
8.5.2 Rider No show policy
If a Rider is booked for a Trip but fails to appear, our Rider no-show policy will be enforced.
8.5.2.1 Carpooll.com keeps the Booking fee, and the rest of the Rider's Payment goes straight to the Driver.
8.5.2.2 A review for not attending is included in the Rider's profile.
8.5.2.3 Carpooll.com has the authority to suspend a Rider's Account anytime if they are suspected of creating a negative experience for other Members by not showing up.
8.5.3 Driver Cancellation Policy
A Driver can cancel a Trip at any time if there are no approved Riders without facing any penalties.
A Driver can cancel up to two Trips with approved Booking(s) or two approved Bookings in a six-month period, which is known as the "Cancellation allowance." If there is another cancellation within six months of the initial cancellation, the Driver's Account will be reviewed and possibly suspended.
The following rules apply with approved booking(s)
8.5.3.1 Full refund to the rider with platform fees
8.5.3.2 Carpooll.com is alerted with cancellation trips
8.5.3.3 Carpooll.com reserves the right to suspend the driver in case of suspicion that the driver is providing a negative rider experience.
8.5.4 Driver no show policy
If a Driver fails to show up for a trip with approved Riders, it is a severe offense that could result in their Account being terminated immediately.
When a Rider fails to show up for a Trip, the Driver reports it to the Carpooll.com team for further investigation.
8.5.4.1 If the absence cannot be confirmed or was accidental, it is denied, and the Driver faces no consequences.
8.5.4.2 If the absence is confirmed and the Driver is not responsible, a no-show evaluation is included on the Driver’s profile, and the Driver’s Account remains active.
8.5.4.3 If the no-show is confirmed and the Driver is found responsible, a no-show review will be posted on the Driver’s profile, and the Driver’s Account could be suspended by our team.
8.5.4.4 Carpooll.com has the ability to suspend a Driver's Account if they suspect the driver is causing a negative experience for other members by not showing up.
8.5.5 In-app Disputes for Canceled Trips, Bookings and Payments
A Driver or Rider can contest a Booking, Cancellation, or Payment that would affect the Driver's Payout within four (4) days of the Trip's scheduled departure on the Service, in accordance with section 8.4.3. If there are no disagreements between the Driver or Rider within four (4) days after the scheduled Trip departure regarding Bookings, Cancellations, or Payments, and the Rider confirms the Trip has taken place, then the Driver will receive their Payment as usual, following the rules outlined in this Section.
Either a Driver or Rider can dispute a Booking within four (4) days by utilizing the review system offered by the Service.
After four (4) days following the scheduled departure of a Trip on the Service, refunds will no longer be issued to the Rider or the Driver.
8.6 Insurance
The driver is responsible for making sure their vehicle is insured according to current laws and for verifying the insurance's validity before each trip. The Driver is required to possess a Driver's license that is current and valid.
Every Driver and Rider must ensure that they are insured while Carpooling by checking with their insurance company.
Drivers with company-provided vehicles must ensure that their insurance policies adequately cover all Riders on a carpooling trip.
Both Drivers and Riders are made aware that their insurance companies may deny coverage for any damage caused in the event of using a private vehicle for commercial purposes, as outlined in section 7.3.
The Member is fully responsible for any insurance claims not covered that may arise from an accident and acknowledges that Carpooll.com bears no liability.
Carpooll.com has the authority to temporarily deactivate a Member's Account and retain any pending Payments if there is a suspicion or acknowledgment of the Member engaging in any business activities associated with the Service, as outlined in section 8.1. Carpooll.com also has the right to report any illegal activities through the Service to the appropriate authorities.
8.7 Legal disputes and disagreements
Carpooll.com offers a contact form for Members to report conflicts and settle disputes. This form is designed specifically to assist Members in resolving disputes related to bookings and cancellations.
Carpooll.com strives to address all requests promptly but is not obligated to resolve every conflict that may occur between Members of the Service.
If a dispute remains unresolved between the Driver and Rider, Carpooll.com has the authority to retain any remaining funds paid by the Rider until a resolution is reached between the two parties or a legal ruling is made.
8.8 Identity Verification
On occasion, like when creating a trip, you might need to verify your identity using an authorized method, Carpooll.com. If you fail to provide proof of Identification or if your identity cannot be reliably verified, you may be denied access to or use of the Service.
You understand and acknowledge that any mention of "verified" information in the Service only indicates that a Member has passed the identity verification process. Carpooll.com publishes these verification references to give you additional information about the Member you are planning to travel with without expressing Carpooll.com's opinion on the person's reliability. You understand that Carpooll.com does not check any Member's reputation, behavior, ethics, criminal history or any other details.
Carpooll.com cannot ensure the accuracy, dependability, or legitimacy of the information supplied by other Members for the identity verification process.

8.9 Referral Program
The Service offers a Referral program for users to utilize. We have the right to increase or decrease the availability of our Referral program or cancel it whenever we choose.
8.9.1 Explanation of the program for recommendations
The Referral program allows members to receive promo codes by referring new members to Carpooll.com, who must create an account, book a trip for the first time and complete it successfully to activate. A Booking marked as "Completed" is when the Driver has accepted it, the Rider has paid for it, and neither party has cancelled or disputed it within four days of the Trip's scheduled departure on the Service.
A Referring Member will give a Promo code to Referred Members through an invitation.
Members who refer others can only receive a promotional code for the initial 500 individuals referred as long as those individuals make their first booking according to the program's terms.
In order to take part, Referring Members must consent to these Terms.
8.9.2 Your referrals
You commit to (i) making your best effort to recommend Referred Members who will make a successful booking on a Trip and (ii) instructing Referred Members on how to utilize the Service, such as how to make Bookings through the Service, by directing them to resources on Carpooll.com. You are not allowed to claim to be a staff member, go-between, or representative or to have the authority to make agreements on behalf of the Company. You are not allowed to produce items (such as business cards, Websites or email addresses) with Company branding or suggest any connection or partnership with Carpooll.com. Nevertheless, it is essential to declare yourself as a Referring Member promoting bookings on Carpooll.com.
You agree and promise to employ referral methods and techniques that are both appreciated by people and in accordance with the law. You must only reach out to individuals who have agreed to be contacted by you. You promise and confirm that you will consistently be considerate of others' privacy (e.g. no spamming) and be truthful, upfront, and clear about your identity and intentions (e.g. no deceiving).
You agree not to create Accounts, make Bookings, or arrange Trips for Referred Members, and you will not receive Promo codes if you violate these Referral Program Terms.
8.9.3 Promo code
A $REFER5 Promo code will be given to you when a Referred Member completes their first booking. Upon signing up and being referred by you, the Referred Member will be given a $REFER5 Promo code.
The Invited Member must register and create an Account within 21 days of receiving the invitation. No deadline exists for finishing your initial Booking as a Referred Member.
Current or former Members will not receive a promotional code for their bookings. All Members referred must be newcomers who are joining for the first time.
Discount codes will be provided up to seven days following each eligible occasion and can be used on the Service for up to six months from the date of issuance.
Carpooll.com has sole discretion in determining if a Promo code is warranted. Carpooll.com has the authority to take action, such as refusing to use a Promo code, holding back Driver Payment or deactivating an Account, if there are suspicions of fraud, tampering, or other breaches of Carpooll.com’s Terms of Service or these Terms.
8.9.4 Nature of relationship
You recognize and accept that a crucial requirement for your involvement in the Referral program is that you are not affiliated with the Company as an employee, intermediary, or agent, and you will not represent yourself as one or mislead others to believe so. You acknowledge that your involvement does not imply the creation of an employment or agency bond between Carpooll.com and yourself. Therefore, you have never been, and are not entitled to be, and now waive any right or claim to, the benefits provided by Carpooll.com to its employees, including vacation time, benefits, salary, bonuses, stock or stock options, profit sharing, insurance, or medical and health benefits. The Company does not hold any liability insurance for you or on your behalf.
8.9.5 Indemnity
You agree to defend, reimburse and absolve Carpooll.com from any claims, damages, liabilities, losses, expenses and costs (including legal and professional fees) resulting from your negligence or intentional misconduct in the Referral program, to the fullest extent allowed by law.
8.9.6 Termination
Carpooll.com has the right to end your involvement in the Referral program at any point, regardless of the reason. The rights and responsibilities of the parties will remain in effect even after this Agreement ends or is terminated.
8.9.7 Exclusion and Limitation of Liability
Carpooll.com will not be held responsible for any special, incidental, exemplary, punitive, or consequential damages of any kind related to this Agreement, regardless of whether the Company was aware of the potential for such damages.
8.9.8 Modification
Carpooll.com reserves the right to change the Referral program at any time, at its sole discretion, by updating this page. By continuing to use the Referral Program, you accept and agree to the modified Terms. If you do not accept the revised Terms, your sole option is to stop using the Referral Program and terminate your participation.
9. Community Agreement

10. Anti-Discrimination and Anti-Harassment Policies
10.1 Anti-Discrimination
Carpooll.com is a community that offers equal opportunities to all. Carpooll.com will prevent any form of discrimination in its community and will do its best to protect against discrimination based on religion, race, color, nationality, or gender. Accusations of discrimination on Carpooll.com could result in the temporary or permanent suspension of a Member's Account.
10.2 Anti-Harassment Policies
Carpooll.com is dedicated to ensuring a community that is harassment-free in every aspect. Harassment of any User based on sex, race, ethnicity, age, religion, national origin, or any other legally protected characteristics is not permitted. Every member must comply with this policy. No Member will face negative consequences when using this Service to report incidents of unlawful harassment by another Member. Accusations of harassment on Carpooll.com could result in the temporary or permanent suspension of a Member's Account.
10.3 Anti Sexual Harassment Policy
Sexual harassment refers to conduct of a sexual nature that is not wanted and is insulting to the individual or individuals it is directed at. Examples of behaviours that constitute harassment may involve unwelcome physical touch, vulgar language of a sexually offensive nature, sexual advances, sexual humor or comments, lewd gestures, and showing pornographic or sexually explicit images, drawings, or portrayals. Using the Carpooll.com platform to access, showcase, or spread sexual content can also be considered as harassing conduct. Accusations of sexual harassment on Carpooll.com could result in either temporary or permanent suspension of a Member's Account.
10.4 Reporting
If a Member believes they have experienced harassment because of their gender, nationality, race, ethnic background, or any other legally protected characteristic, they should promptly get in touch with Carpooll.com. After the report is made, it will be promptly looked into, and any needed steps will be taken to address the issue. All reports of illegal harassment will be addressed discreetly and confidentially as feasible, given the situation.
11. Privacy

We acknowledge your worries regarding your privacy and value your right to safeguard your personal information online. Our service is created for members to share information on trip dates and locations only. We might gather additional personal information from you that we do not share on our platform.

11.2 Third-Party Content
Using our Service, you may come across material from other Members or third parties ("Third-Party Content") on our platform or via links to external websites. We do not have authority over or accountability for Third-Party Content. You are responsible for assessing and accepting all risks related to Third-Party Content.
12. Conditions for Liability, Warranties, Indemnity, Intellectual property and other Legal matters
12.1 Limits of Liability
If not prohibited by law, especially under the "Consumer Protection Act" in Québec, we will not be held responsible for any type of damages (including direct, indirect, incidental, general, special, consequential, exemplary or punitive damages) related to a using our Service or inability to do so b) replacing goods, services or information obtained through our Service c) unauthorized access or changes to your content d) loss of data, service interruptions e) actions related to using the services, including bodily injury or emotional distress, arising from interactions with other Members introduced online or offline, or any other matters related to our services or terms. Carpool.com will not be liable for any claim from a Member that exceeds $25 in payment.
12.2 Disclaimer of warranties
If the specified exemptions are not prohibited by law, especially under the "Consumer Protection Act" for residents of Quebec, using our Service is solely your responsibility. Our services are offered based on their availability. We deny all warranties, whether express or implied, including merchantability, fitness for a specific purpose, and non-infringement, and you give up these rights.
We cannot guarantee that:
12.2.1 Our Service will fulfill the needs you have or the hopes you hold.
12.2.2 Our Service will not be interrupted, delayed, insecure, or error-prone.
12.2.3 Any data you receive from our Service will be dependable and precise.
12.2.4 Mistakes in data or software will be fixed.
12.3 Indemnity
If the listed exceptions are not prohibited by law, especially under the "Consumer Protection Act" if you live in Québec, you must protect, compensate and keep us safe from any claims, demands, actions, damages, losses, costs or expenses, such as reasonable legal fees, related to your use of our Service. If you have a responsibility to compensate us, we will be entitled to manage any legal action and decide if we want to resolve it, and if yes, under what conditions.
